 Music License Terms for Multimedia Creators by BT LOOPS

Navigating music licensing can often seem daunting, but we’re here to simplify the process for you. Our licensing terms are crafted with clarity and flexibility in mind, ensuring you can focus on what you do best—creating outstanding content—without worrying about the legalities of music use.

Definitions:

  • For the purposes of these Terms and Conditions, a “Track” or “Tracks” refer to any audio recording, including but not limited to music samples, loops, soundscapes, and any other form of sound recording, available for purchase or license on the BT LOOPS platform. Tracks are provided in digital format and are accessible for use in accordance with our licensing terms.
  • Within these Terms and Conditions, “Multimedia Projects” refer to any creative or commercial work that incorporates multiple forms of media content, including but not limited to audio, video, text, and graphics. This encompasses a wide range of outputs such as music compositions, video productions, podcasts, video games, films, advertisements, presentations, and any digital or physical media creations. Multimedia Projects may utilize Tracks purchased or licensed from the BT LOOPS platform as part of their audio components. The inclusion of BT LOOPS’ Tracks in Multimedia Projects is subject to the specific licensing terms agreed upon at the time of purchase or download, which dictate the manner and extent to which the Tracks can be used within these projects.
  1. License Grant

Under the terms of this Terms, you’re given a non-exclusive, worldwide, royalty-free, perpetual, non-transferable, and non-sublicensable, license to reproduce the Tracks, with or without modifications, solely for their incorporation into your Multimedia Projects, and to reproduce, distribute, transmit, publicly perform or display, communicate and make available to the public, and to otherwise use the Tracks (with or without modifications thereto) solely as so incorporated into such Multimedia Projects, in all media and formats whether now known or hereafter created, including for commercial purposes within limitations stated in these Terms:

  • Video Games: including but not limited to mobile games, console games, PC games, online multiplayer games, virtual reality (VR) experiences, and augmented reality (AR) applications. When Tracks from the BT LOOPS platform are used within Video Games, the license granted is unlimited, permitting the incorporation of these Tracks regardless of the game’s budget, size, or distribution platforms.
  • Film, Streaming or Social Media Videos:
    1. Film: incorporation of Tracks in a wide range of cinematic creations, from short films to feature-length movies, across genres such as drama, comedy, documentary, action, and animation. The category of Film also encompasses animated movies, which use drawn, painted, or digitally created frames.
    2. Streaming or Social Media Videos: incorporation of Tracks in digital video content that is created, shared, and viewed on streaming platforms and social media networks. This includes live streaming sessions, video blogs (vlogs), tutorials, promotional videos, and any other video content designed for engagement on platforms such as YouTube, Twitch, Instagram, TikTok, and Facebook, among others. This excludes adding Tracks from music libraries that are an in-app part of aforementioned platforms.
  • Limitations:
In some countries a film metric fulfillment might be required by law. The completion and submission of the film metric is the responsibility of the Film creators and must be done in accordance with any applicable local laws and regulations governing copyright and music licensing in their jurisdiction. BT LOOPS is not responsible for veryfing the necessity of correctness of such submission. 
 
If the film metric concerns your case, we require users who incorporate BT LOOPS’ Tracks into Film projects to ensure the completion of a film metric regarding the music used in their creations, if applicable. This metric, or report, should include details such as the titles of the Tracks used, the
authors of the Tracks and the duration of their use within the Film, and any other relevant information. See Section 12 for a film metric details and examples.
  • Podcast or other audio projects:
    1. Episode Incorporation: You may include the music within podcast episodes.
    2. Distribution Platforms: The music can be used in episodes distributed across various platforms, including streaming services and podcast directories.
    3. Limitation on Advertising: Music shall not be used in standalone advertising spots within or outside of the podcast without prior written consent from BT LOOPS

This license is valid only for the entity or individual purchasing the license.

The license obtained with the purchase of any Track from BT LOOPS is designated for use in a single, specific Multimedia Project. This encompasses not only the primary project for which the Track is initially licensed but also extends to any and all projects that are directly connected with, or arise as a result of, the original Multimedia Project.

It is crucial to distinguish, however, that while the license covers the use of the Track within the original project and any directly connected projects, derivative works are categorized differently under this agreement. For the purposes of this license, a “derivative work” is defined as any new, standalone project that is based upon the original Multimedia Project but is created to serve as a separate entity rather than as a continuation or direct extension of the original project.

Standalone projects (excluding Sequels) that originate from the original project but are intended to be separate entities require a new license, as they are considered separate Multimedia Projects under this agreement.

  1. Permitted Uses
  • Integration in Multimedia Projects: see Section 1.
  • Promotional Usage: Use of the music in trailers, advertisements, and promotional content specifically related to your Multimedia Project.
  • Public Performance: The Tracks can be included as part of the public viewing, broadcasting, or streaming of your Multimedia Project.
  1. Restrictions
  • No Resale or Redistribution: Keep in mind, that this License does not allow you to use any Tracks on a stand-alone basis or in isolation, such as sound effects or as loops, sell, loan, lend, share, give, broadcast, rent, assign or otherwise distribute, transfer, provide or make available to anyone any tracks except as incorporated into your Multimedia Project, use any Track for the creation of a sound or sample library or as a sound or sample library or part thereof, including for any kind of synthesizer, virtual instrument, sample library, sample-based product or other musical instruments, or sell, loan, lend, share, give, broadcast, rent, assign or otherwise distribute, transfer, provide or make available to anyone any Track or any part of the Track on a stand-alone basis or as repackaged into audio samples, sound libraries or sound effects, except as permitted by BT LOOPS. Otherwise, you are allowed to use any Track however you would like, as long as you incorporate the Tracks in your Multimedia Project and follow the terms under the License.
  • No Claim of Ownership: Ownership, authorship, or exclusive rights to the music cannot be claimed.
  • No Alteration: Significant alteration, remixing, or using the music as a basis for derivative works is prohibited.
  • Non-transferable License: This license is personal and cannot be sold, leased, assigned, or transferred to any third party.
  1. Credits and Acknowledgement

Appropriate credit to BT LOOPS and optionally the original composer must be provided in your project’s credits, accompanying documentation, or in any public display or distribution of the project, i.e.:

  1. Change or Termination of License
  • BT LOOPS reserves the right to change or terminate this license immediately upon its sole disclosure or any breach of these terms. Upon change, all usage of the music must comply with new terms and license. Upon termination, all usage of the music must cease and any copies must be destroyed.
  • Upon the purchase of any Track from BT LOOPS, the Licensee acquires a license to use the Track under the terms and conditions that are in effect at the moment of purchase. We recognize that over time, licensing terms and conditions may undergo revisions or updates to reflect changes in legal requirements, industry standards, or our business practices. However, it is important to note that any such changes will apply only to licenses acquired after the implementation of these changes. For all Tracks purchased prior to any modification of the licensing terms, the Licensee’s rights and obligations remain governed by the license terms as they were at the time of their original purchase.
  1. Liability and Indemnification

BT LOOPS is not liable for any indirect, incidental, special, or consequential damages from using the music. The licensee agrees to indemnify BT LOOPS against claims, damages, and expenses arising from misuse of the music.

  1. Governing Law and Jurisdiction

This agreement is governed by the laws of Poland, with legal actions brought in Polish courts.

  1. Entire Agreement

This document is the complete agreement between you and BT LOOPS regarding music usage, overriding all prior agreements.

  1. Amendment

BT LOOPS may amend these terms, with continued music usage constituting acceptance of new terms.

  1. Public Rights Organizations (PROs)

Tracks are royalty free, but in cases where the Author of any Track available on BT LOOPS is a member of performance rights organizations (PROs) or similar entities responsible for music rights management, Licensees are obligated to adhere to additional reporting and compliance measures.

  1. Content ID
Tracks are safe to use within YouTube platform and there should be no risk of receiving a copystrike. However, if any problem occurs Licencees should present their License to YouTube as a proof. If Licencees happen to have any further problems they should contact our support team: support@btloops.com

Licencees or any other third-party users are not allowed to claim the Tracks as their own copyrigh within YouTube Content ID system under legal consequences.

  • Music Publisher: “BT LOOPS Sp. z o.o.
  • Author: appropriate name and surname of the Track’s Author, i.e. “Jack Newman
  • Title: appropriate title of the Track, i.e. “Lands
  • Duration of the Track used in the Film: (example) “3 minutes 24 seconds” or “3 min 24 sec
